PROBATE COST IN CALIFORNIA

HOW MUCH DOES PROBATE COST?

Per California Probate Code Sections 10800 & 10810, the following attorney’s fees are statutorily established.

            • 4% of the first $100,000
            • 3% of the next $100,000
            • 2% of the next $800,000
            • 1% of the next $9,000,000

Both the executor and the attorney are entitled to the above fees. Therefore probate could cost as much as:

            • $16,000 for a $250,000 estate
            • $26,000 for a $500,000 estate
            • $46,000 for a $1 million estate
            • $66,000 for a $2 million estate
            • $86,000 for a $3 million estate
            • $106,000 for a $4 million estate, etc.

Why would you needlessly subject your heirs to these costs? These costs are completely avoided it you have a living (revocable) trust that is fully funded.
